The agreement governing your use of the Rokstr Sports platform, photo marketplace, and related services.
These Terms & Conditions ("Terms") constitute a legal agreement between you and Richmond County Media, LLC, d/b/a Rokstr Sports ("we," "us," or "our"), governing your access to and use of the Rokstr Sports website, mobile applications, and related services (collectively, the "Services"). By creating an account, accessing, or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old to create an account and use the Services. By registering, you represent that you are an adult — a parent, legal guardian, coach, or league administrator. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account.
Rokstr Sports is designed for use by adults but processes information about children under 18, including children under 13, who are athletes on team rosters. Children do not create or hold accounts. All information about a child is submitted and managed by an authenticated adult account holder.
If you add a child to a roster, upload a child's photograph, or otherwise provide a child's information, you represent and warrant that you are the child's parent or legal guardian, or that you have obtained the verifiable consent of the child's parent or legal guardian to do so. Our collection and use of children's information is governed by the children's privacy provisions of our Privacy Policy (COPPA Supplement).
You retain ownership of the photographs and other content you upload ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to host, store, process, watermark, display, and deliver that content as necessary to operate the Services, including generating galleries and fulfilling orders.
You represent that you have all necessary rights and permissions to upload your User Content, and that doing so does not violate the rights of any person — including the privacy or publicity rights of any individual depicted, and the consent requirements applicable to images of children. You are solely responsible for the content you upload.
The Services include a marketplace for purchasing digital photo downloads and print-on-demand merchandise. Prices are displayed at the point of purchase. Payments are processed by our third-party payment processor (Stripe); by making a purchase you also agree to the payment processor's terms.
By providing your mobile number and opting in, you consent to receive text messages from Rokstr Sports, including photo alerts, gallery and order updates, and account notices. Consent is not a condition of purchase. Message frequency varies and message and data rates may apply. Reply STOP to unsubscribe or HELP for help. The Services, including all software, design, text, graphics, and trademarks (excluding User Content), are owned by or licensed to Richmond County Media, LLC and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works from the Services without our prior written consent.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any photo-matching feature (including facial recognition or jersey-number detection) will be accurate in all cases.
To the maximum extent permitted by law, Richmond County Media, LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred U.S. dollars ($100).
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Services and request account deletion at any time. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Richmond County, New York, unless otherwise required by applicable law.
We may modify these Terms from time to time. We will post the updated Terms with a new "Last updated" date, and material changes may be communicated through the Services or by email. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
